On November 28, 2007, a Yakima County jury ruled in favor of an
injured passenger of a vehicle that struck a table in the roadway. State
Farm denied coverage under the passenger's Underinsured Motorist Policy, stating
that the passenger could not prove that the table in the roadway was there as
a result of a motorist. The injured passenger hired Tamaki Law and filed
a lawsuit against State Farm. Contrary to State Farm's position, the jury
unanimously found that the table was in the roadway as a result of a motorist,
therefore requiring State Farm to cover the passenger's bodily injury claim stemming
from the accident. State Farm must now pay all of the plaintiff's attorney's
fees, in addition to covering the passenger's bodily injury claim.
